Website Terms of Use

1. Acceptance

This website is operated by Flow Force Hydraulics Pty Ltd (ABN 66 701 139 728) trading as Flow Force Hydraulics (“we”, “us” or “our”). By accessing or using this website, you agree to these Website Terms of Use. If you do not agree, do not use the website.

2. General information only

Website content is general information about our business, products and services. It is not engineering, safety or technical advice for a particular machine, system, site or application. Hydraulic systems can store energy and present serious hazards. Inspection, diagnosis, isolation, repair and testing should be performed by appropriately competent people using information relevant to the equipment and circumstances.

Do not rely on website content as a substitute for an inspection, manufacturer specification, safe-work procedure or professional advice.

3. Quotes, bookings and availability

Submitting an enquiry or quote request does not create a booking or require us to provide goods or services. A booking or order is accepted only when we confirm acceptance. Product, technician and response-time availability may change.

Any website estimate, “from” price, service area or response-time statement is indicative unless we expressly confirm it in writing for your request. Emergency and breakdown attendance remains subject to technician availability, location, access, safety and circumstances beyond our reasonable control.

4. Accuracy

We take reasonable care with website information but do not promise that all content is complete, current or error-free. Product photographs may be illustrative. Specifications, availability and manufacturer information may change without notice. Please contact us to confirm information important to your decision.

5. Acceptable use

You must not:

  • use the website unlawfully or in a way that infringes another person’s rights;
  • interfere with the website, its security or other users;
  • introduce malicious code or attempt unauthorised access;
  • scrape, copy or exploit website content for commercial purposes without permission; or
  • submit false, misleading, abusive or unlawful material through a form.

6. Intellectual property

Unless otherwise stated, website content—including our branding, text, graphics, photographs and layout—is owned by or licensed to us and protected by intellectual-property laws. You may view and print content for your personal or internal business use. No other reproduction, modification, distribution or commercial use is permitted without prior written consent.

Third-party product names and trade marks remain the property of their respective owners. Their appearance does not necessarily indicate endorsement or affiliation.

7. Third-party links and platforms

The website may link to third-party websites, maps, social media or services. We do not control them and are not responsible for their content, availability, security or privacy practices. You use third-party services under their own terms.

8. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

To the maximum extent permitted by law, we are not liable for loss arising solely from your reliance on general website information, inability to access the website, malicious third-party activity or third-party websites. Where the law permits us to limit a liability, our liability is limited to the extent permitted by law.

9. Privacy

Our Privacy Policy explains how we handle personal information collected through the website and our business activities.

We may update these terms or alter, suspend or withdraw website content at any time. The version published on the website applies from its stated effective date.

Service and Supply Terms

Important: These terms affect contractual rights and liability. Have an Australian solicitor review them against the way Flow Force Hydraulics actually quotes, charges, supplies parts, performs field work and provides credit before using them in customer contracts.

1. Application and acceptance

These Service and Supply Terms apply when Flow Force Hydraulics Pty Ltd (ABN 66 701 139 728) trading as Flow Force Hydraulics (“we”, “us” or “our”) supplies goods or services to a customer (“you”). They apply together with our accepted quote, work order, booking confirmation or credit agreement. If there is an inconsistency, the more specific written document takes priority to the extent of the inconsistency.

You accept these terms by approving a quote, placing an order, requesting that we commence work, providing site access or accepting supplied goods or services.

2. Quotes and scope

A quote is valid for seven days from its date of issue unless stated otherwise. After that period, pricing and availability may be reviewed before the quote is accepted. A quote is based on the information and access available when it is prepared. Unless expressly included, a quote does not cover concealed damage, additional faults, unavailable or obsolete components, recovery or transport, specialist access equipment, after-hours work, freight or work required because information supplied to us was incomplete or inaccurate.

If further work or cost becomes reasonably necessary, we will seek approval where practicable. During an urgent breakdown, if we cannot promptly contact the authorised representative, we will not undertake material additional work without approval unless it is reasonably necessary to make the equipment or site safe.

3. Call-outs, labour and travel

Call-out, minimum labour, travel, after-hours, inspection, diagnostic and other applicable charges will be stated in the quote, booking confirmation or current rate schedule. Time spent diagnosing a fault is chargeable even if the fault cannot immediately be repaired, parts are unavailable or you decide not to proceed with the repair.

4. Customer responsibilities

You must:

  • provide accurate information about the equipment, fault, location and known hazards;
  • ensure we have safe, lawful and timely access to the equipment and work area;
  • identify site rules, inductions, permits, isolation requirements and hazardous materials before work begins;
  • provide any reasonably required operator, lifting assistance, power, lighting or site support agreed with us;
  • ensure the equipment is available at the agreed time; and
  • ensure that the person approving work has authority to do so.

We may stop or refuse work where conditions are unsafe, access is inadequate, required information has not been provided or continuing would breach a legal or site requirement. Reasonable attendance and time costs remain payable.

5. Parts and substitutions

Parts are subject to supplier availability. If an exact part is unavailable, we will seek approval before using a materially different substitute. Replaced parts will be disposed of unless you task us to retain them before work begins, except where they must be returned to a supplier for warranty assessment or core credit.

6. Timing

Attendance, delivery and completion times are estimates unless we expressly agree otherwise in writing. We will use reasonable efforts to meet stated times but delays may arise from safety conditions, traffic, weather, site access, supplier availability, freight, equipment condition or other circumstances beyond our reasonable control.

7. Price, GST and payment

Unless expressly stated otherwise, all prices and charges are exclusive of GST. GST will be added at the applicable rate where required by law.

Payment for services is due immediately upon completion of the work. Goods must be paid for in full before they are collected, delivered or otherwise released to you. Payment is not treated as received until the funds have cleared into our nominated account.

Different payment terms apply only where we have approved a credit account for you in writing. Approved account customers must pay each invoice within 30 days of the invoice date unless different terms are agreed in writing. We may suspend or withdraw credit facilities if an account is overdue or if we reasonably consider there to be an increased credit risk.

We may require a deposit, progress payment or payment before ordering special or non-returnable parts. You must notify us promptly if you genuinely dispute an invoice and pay any undisputed portion by the due date.

8. Cancellations and returns

You may cancel a booking by giving reasonable notice. We may charge reasonable costs already incurred, including ordered parts, supplier restocking charges, freight, allocated labour or attendance where permitted by law. Special-order, cut-to-length, made-to-order or used goods cannot be returned for change of mind unless we agree.

Nothing in this section limits rights or remedies that cannot lawfully be excluded.

9. Inspection after service

You must inspect supplied goods and completed work as soon as reasonably practicable and promptly tell us about any concern. You must stop using equipment and notify us immediately if continued operation may be unsafe or cause further damage. This notice requirement does not remove rights that cannot lawfully be excluded.

10. Consumer guarantees and warranties

Our goods and services may come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right or remedy that cannot lawfully be excluded.

Any additional workmanship or manufacturer warranty we offer will be described in the quote, invoice or warranty document, including its duration and claim process. A warranty does not cover fair wear and tear, misuse, contamination, incorrect operation, unauthorised modification, failure to follow maintenance requirements, or a separate fault not caused by our goods or services, except to the extent the law provides otherwise.

11. Liability

Nothing in these terms excludes, restricts or modifies liability that cannot lawfully be excluded, restricted or modified.

Where you acquire goods or services for business purposes and the law permits us to limit a liability, our liability is limited, at our option, to one or more of the remedies permitted by law, such as resupplying the services, paying the reasonable cost of resupply, replacing or repairing goods, or paying the reasonable cost of replacement or repair.

To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the contract was made. This does not limit liability where doing so would be unlawful.

12. Ownership and risk in goods

To the extent permitted by law, all goods remain the property of Flow Force Hydraulics until we have received cleared payment in full for those goods and all amounts relating to their supply. Unless we agree otherwise in writing, goods will not be collected, delivered or released before payment is received.

Risk of loss of or damage to goods passes to you when the goods are collected by you, delivered to you or delivered as you direct. Passing of risk does not transfer ownership. Until ownership passes, you must keep the goods identifiable, properly stored and protected, and must not sell, dispose of, alter or grant a security interest in them without our written consent.

Where permitted by law, if payment is overdue, we may require the return of unpaid goods and exercise any rights available to us under applicable law. Nothing in this clause authorises entry onto premises without permission or other lawful authority.

13. Privacy

We handle personal information in accordance with our Privacy Policy.

14. Disputes

If a dispute arises, each party should give the other written details and allow a reasonable opportunity to respond. The parties will first attempt to resolve the dispute in good faith. This does not prevent either party from seeking urgent relief or exercising a right available under law.

15. Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of its courts and courts entitled to hear appeals from them.
